It is a condition of use of the yagade.com that each User and advertiser consents and authorizes yagade.com and Top Brand Advertising to collect and use this information. Yagade.com and Top Brand Advertising also reserves the right to disclose it to Company Affiliates and any other person to administer, support, and maintaining Tonaton.com and improving Tonaton.com, for example, by using the information for research, marketing, product development, and planning.

Yagade.com and Top Brand Advertising do not guarantee continuous or secure access to the Web Site. The Web Site is provided “as is” and as and when available.

Links to third-party websites

Yagade.com may contain links or references to other websites (‘Third Party Websites’). Yagade.com and Top Brand Advertising shall not be responsible for the contents of Third-Party Websites. Third-Party Websites are not investigated or monitored. If the user decides to leave yagade.com and access Third Party Sites, the user does so at his/her own risk.

Paid content and services

Some content and services of yagade.com require payment, including but not limited to membership packages, posting of ads in select categories, and sale of items through Doorstep Delivery.

Users may purchase ad promotions using vouchers issued or sold by yagade.com. Coupons may not be redeemed for cash.

Advertisers and Users may be required to transmit Paid Content information through a third-party service provider, which its terms of use may govern Linking to any third-party service providers are at the Users’ and Advertisers’ own risk, and yagade.com disclaims all liability related to it. Under no circumstances shall Tonaton.com be obliged to refund any payments made concerning Paid Content.

Memberships

As part of a membership package, yagade.com will create a Shop on behalf of the user. A Shop is a dedicated webpage on yagade.com, maintained by yagade.com, with the user’s content. yagade.com has the right to any content added to the shop by the user and can remove or not publish the content if it violates any Terms and Conditions aspect.

yagade.com reserves the right to modify or change membership packages, including the price and the contents of the membership package.

yagade.com is not obligated to refund money or services if a membership package is canceled early, for any reason.

Doorstep Delivery

Doorstep Delivery is an eCommerce service provided by yagade.com to help Buyers get items delivered to their doorstep. In some cases, the delivery and payments are handled by the Seller, while in other cases, they are driven by yagade.com. Whether an item will be delivered by the Seller or by yagade.com will be specified in the ad.

A seller has to be a member on yagade.com to opt into the Doorstep Delivery service. For seller-related terms and conditions, please contact your field sales executive (or refer to the material provided by your field sales executive).

By placing a ‘Doorstep Delivery’ order, Buyers undertake to purchase the item unless it is materially different from the Seller’s description on yagade.com. If the delivered item is not described in the ad, the Buyer is entitled to a free replacement of the product under yagade.com’s Buyer Protection policy.

yagade.com does not provide any guarantees that Sellers have been truthful or accurate in their listings, have items in stock, will accept the return of the article, or provide any refunds. yagade.com is not responsible for the unsatisfactory or delayed performance, losses, damages, deals resulting from framings being unavailable or mishandled by Sellers.

yagade.com reserves the right to suspend, limit or withdraw access to yagade.com and Membership of any user who does not comply with these terms.

Disclaimer

yagade.com and Top Brand Advertising Assume no responsibility what so ever for the use of yagade.com and disclaims all responsibility for any injury, claim, liability, or damage of any kind resulting from or arising out of or any way related to (a) any errors on yagade.com or the Content, including but not limited to technical errors and typographical errors, (b) any third party web sites or content directly or indirectly accessed through links in yagade.com, (c) the unavailability of yagade.com, (d) your use of yagade.com or the Content, or (e) your use of any equipment (or software) in connection with yagade.com

Indemnification

Advertisers and users agree to indemnify yagade.com & Top Brand Advertising as well as its officers, directors, employees, agents, from and against all losses, expenses, damages, and costs, including attorney’s fees, resulting from any violation of these Terms and Conditions (including negligent or wrongful conduct).

Modifications

yagade.com & Top Brand Advertising reserves the right to modify these Terms and Conditions. Such modifications shall be effective immediately upon posting on yagade.com. You are responsible for the review of such changes. Your continued access or use of yagade.com shall be deemed your acceptance of the modified terms and conditions.

Governing law

yagade.com is operated under the rules and regulations of Ghana.
